General Sales Conditions (GSC)
1. Introduction
These General Terms and Conditions of Sale (GTCS) govern all sales made on the Elysessence.ch website operated by PIRLOT Import-Export, registered in the Ticino Trade Register, with headquarters in Bellinzona. By placing an order on our site, you accept these conditions fully and without reservation.
2. Products and availability
Our products are described and presented as accurately as possible. However, there may be slight variations between the photos and the actual product. Product availability is indicated on the website and is subject to change without notice.
3. Price and currency
- Prices are displayed by default in Swiss francs (CHF) and include VAT applicable in Switzerland.
- Delivery charges are not included in the prices shown and will be added at the time of ordering.
4. Orders and payment
- You can order with or without creating an account.
- All orders are considered valid once payment has been confirmed.
- Payments can be made using any of the methods offered on our site (credit card, paypal, etc.).
- We reserve the right to cancel any order in the event of non-payment or suspected fraud.
5. Delivery
We deliver in Switzerland and Europe
Delivery charges are payable by the customer, except for orders of :
- CHF 100.00 in Switzerland
- 160.00 CHF outside Switzerland
- Delivery times vary according to destination and chosen carrier. We cannot be held responsible for delays beyond our control.
Lost or undelivered parcels
Before receipt by the customer: If a parcel is lost or does not reach its destination due to a carrier error, we will open an investigation with the delivery service concerned.
- If the loss is confirmed, we will either return the product at no extra cost, or issue a full refund at your discretion.
- However, if the parcel is marked as “delivered” by the carrier, we cannot be held responsible and no compensation will be granted.
Error in address supplied by customer
If the parcel is lost due to an error in the address given when the order was placed, the customer will be responsible for the cost of returning the parcel.
If the parcel is delivered to the wrong address provided by the customer, we cannot be held responsible and no refund will be made.
To avoid any errors, we recommend that customers check their information carefully before confirming their order. A confirmation e-mail will be sent after each purchase to indicate any corrections before shipment.
6. Right of withdrawal and returns
In accordance with current legislation and due to the nature of our products (creams, serums, body care products), returns are only accepted in the following cases:
- Error on our part when sending the product.
- Defective product with confirmation of defect by manufacturer or supplier.
For reasons of hygiene and safety, no returns or refunds will be accepted if the product has been opened or used.
7. Liability
We make every effort to ensure the accuracy of the information and the quality of the products sold on our site.
However, we cannot be held responsible for damage resulting from misuse of the products purchased.
8. Intellectual property
All content on our site (text, images, logos, etc.) is protected by intellectual property law.
Reproduction in whole or in part without written permission is prohibited.
9. Personal data protection
Your personal data is collected and processed in accordance with our Privacy Policy and in compliance with Swiss and European laws (RGPD).
10. Modification of the GTC
We reserve the right to modify these conditions at any time. The new conditions will come into force as soon as they are published on our website.
11. Applicable law and jurisdiction
These GTC are governed by Swiss law.
In the event of a dispute, the competent courts are those of the Canton of Ticino.
